SWEEPSTAKES OVERVIEW. This Sweepstakes allows you to enter for a chance to win one (1) grand prize. You can enter only by signing up via email.
ADMINISTRATOR. This Sweepstakes is administered by Chive Media Group, LLC (“Administrator”) and will be conducted under the supervision of Administrator.
ACCEPTANCE OF RULES. By entering this Sweepstakes, you fully and unconditionally accept and agree to these Rules and all decisions made by Administrator, which are final and binding on all matters related to the Sweepstakes.
ELIGIBILITY TO ENTER. This Sweepstakes is only open to permanent legal U.S. residents of the United States, Puerto Rico and the District of Columbia, who are at least 21 years old as of the beginning of the Sweepstakes Period (defined herein), the exception being residents of Florida, New York, or Rhode Island, to whom this Sweepstakes is not open. Employees of Administrator and/or their respective parents, subsidiaries, and affiliates, and employees of any advertising or promotion agencies or any other entity involved in the sponsorship, conducting, or development of this Sweepstakes, and their immediate family members (spouse, parent, child, sibling and their respective spouses, regardless of where they reside) or household members are not eligible to enter. By entering this Sweepstakes, you represent that you are at least 21 years of age and own a blockchain wallet during the Sweepstakes Period.
TIMING OF SWEEPSTAKES. This Sweepstakes is only open for entry during the following period (the “Sweepstakes Period”) (Chive Media Group’s time-stamp record will serve as the official time keeping device for the Sweepstakes period. Drawing will take place April 8, 2022):
Sweepstakes begins on March 1, 2022 at 12:00 a.m. CST.
Sweepstakes ends on April 7, 2022 at 11:59 p.m. CST.
HOW TO ENTER. YOU MAY ONLY ENTER THIS SWEEPSTAKES 1 TIME. There is no purchase necessary to enter. You may enter using the following method:
1. Free Method of Entry: Sign up via email to enter Sweepstakes.
All information submitted during any method of entry must be complete and accurate, or your entry will be disqualified. You may only enter this Sweepstakes on behalf of yourself; you may not enter this Sweepstakes on behalf of any other person. The owner of the email address used to sign up and enter will be deemed the entrant into Sweepstakes. You may be required to show proof of ownership of your email account and blockchain wallet used to enter this Sweepstakes.
If you qualify for entry into the Sweepstakes, but wish to opt-out from entry and withdraw yourself from participation and the chance to be a Winner, please contact Administrator at help@thechivery.com and Administrator will arrange to withdraw you from entry into the Sweepstakes.
WINNER SELECTION One(1) Grand Prize winner (the “Winner”) will be selected by random chance drawing from all eligible entries validly received during the Sweepstakes Period (the Winner is referred to as “Winner”). Odds of winning depend on the total number of eligible entries received.
The Winner will be the eligible entrant who is randomly selected first by Administrator from all eligible entrants. On April 8, 2022, potential prize winners will be selected in a random drawing from all eligible entries received by Administrator. Odds of winning depend on the number of eligible entries received for the Sweepstakes. By entering the Sweepstakes, you fully and unconditionally agree to be bound by these Sweepstakes Rules and the decisions of the Administrator and other Sweepstakes Entities, which will be final and binding in all matters relating to the Sweepstakes.
PRIZES
Grand Prize.

PRIZE RESTRICTIONS. ALL PRIZES ARE SUBJECT TO THE FOLLOWING RESTRICTIONS, AS APPLICABLE:
General Restrictions. Limit of one (1) prize per person and per household. All Prizes are non-transferable and have no cash redemption or substitution value, except that Administrator, in its discretion, reserves the right to change, substitute, or replace any Prize at any time with one of greater or comparable value if any part of the Prize becomes unavailable for any reason. Administrator will not be responsible for or replace any lost or stolen Prizes. To be awarded and claim a Prize, the potential Winner must meet all eligibility requirements, comply with these rules, and be ready, willing, and able to claim the Prize. No more than the stated number of Prizes will be awarded. The actual retail value of a Prize may be different from the stated approximate retail value due to location, market conditions, changes in values/rates for Prize components, or for other similar reasons; if so, Winners will not be entitled to receive any difference in value. All unclaimed Prizes or unused portions of a Prize will be forfeited in their entirety. The winner is responsible for all costs and expenses not included in the Prize description.
ALL PRIZES ARE AWARDED “AS IS.” ADMINISTRATOR DOES NOT MAKE AND DISCLAIMS ANY AND ALL REPRESENTATIONS AND WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, RELATING TO THE PRIZE, INCLUDING WITHOUT LIMITATION, ALL WARRANTIES OF MERCHANTABILITY AND/OR FITNESS FOR A PARTICULAR PURPOSE OR THAT ANY PRIZE WILL BE FREE FROM ERRORS OR DEFECTS.
NOTIFICATION OF WINNER. After selection of the potential Winner and within seven (7) days, Administrator will contact potential Winner by including correspondence within the potential Winner’s submission, by email at the address provided at entry, or by other method reasonably sufficient to notify the potential Winner that he/she is a potential Winner and to arrange for the potential Winner to claim the Prize. Winner is required to provide Administrator with their names, residential addresses, telephone numbers, email addresses, and must present valid government-issued photo ID (such as license or passport) upon Administrator’s request.
ALL POTENTIAL WINNERS MUST RESPOND TO ADMINISTRATOR BY APRIL 8, 2022 TO CLAIM THEIR PRIZE. IF POTENTIAL WINNER DOES NOT RESPOND BY THAT DATE, HE/SHE WILL AUTOMATICALLY FORFEIT HIS/HER OPPORTUNITY TO WIN THE PRIZE. WINNERS MUST MEET ALL ELIGIBILITY REQUIREMENTS AND COMPLY WITH THESE TERMS TO WIN THE PRIZE. ALL POTENTIAL WINNERS ARE SUBJECT TO VERIFICATION OF ELIGIBILITY AND COMPLIANCE BY ADMINISTRATOR, WHICH VERIFICATION IS IN THE ADMINISTRATOR’S SOLE DISCRETION, AND ALL ADMINISTRATOR’S DECISIONS WITH RESPECT THERETO ARE FINAL. NO ENTRANT WILL BE DECLARED A WINNER UNTIL AND UNLESS ADMINISTRATOR HAS VERIFIED THE POTENTIAL WINNER’S ELIGIBILITY, AND AN ENTRANT/POTENTIAL WINNER IS NOT A WINNER OF ANY PRIZE UNTIL AND UNLESS HIS/HER ELIGIBILITY HAS BEEN VERIFIED AND THE ENTRANT/POTENTIAL WINNER HAS RECEIVED NOTICE FROM ADMINISTRATOR THAT HE/SHE HAS WON THE PRIZE, EVEN IF ANY INFORMATION ON ADMINISTRATOR’S WEBSITE INDICATES THAT AN ENTRANT HAS WON.
TAXES AND FORMS. Winner is solely responsible for all federal, state, and local taxes associated with the value of the Prize, and for any shipping and handling charges related to delivery of the Prize. Winners agrees to execute and return (and winning may be conditioned upon the Winner executing and returning) to Administrator, a form W-9, Affidavit of Eligibility, Liability and Publicity Release, and
any other forms requested by Administrator, in form and substance acceptable to Administrator, in order to be eligible to claim and receive the Prize.
CANCELLATION AND DISQUALIFICATION. Administrator reserves the right to, in its discretion, cancel, suspend, and/or modify the Sweepstakes (or any part thereof) and/or to disqualify any entrant, Winner, or potential Winner in any of the following events (each “Disqualifying Event”):
• Administrator has reason to believe there exists any tampering, fraud, delay, unauthorized intervention, cheating, technical failures, or any other factor, technical failures, or other causes that corrupt the administration, security, fairness, integrity, or proper functioning of the Sweepstakes;
• Any entrant fails to comply with these Rules or any applicable law, rule, or regulation;
• Any entrant annoys, abuses, threatens, or harasses any other entrant or Administrator;
• Administrator’s technical systems become otherwise impaired for any reason, in a manner that may affect the administration, security, fairness, integrity, or proper functioning of the Sweepstakes;
• Administrator is unable to verify the eligibility of a Winner or potential Winner, or Administrator determines a Winner or potential Winner to be ineligible;
• Any entrant fails to provide current and correct contact information for when entering;
• Any person attempts to exceed the limit of number of entries into the Sweepstakes by any method, including but not limited to, using multiple email addresses or accounts or robotic entries;
• A Winner or potential Winner refuses, declines, or is not ready, willing, or able to accept and claim the Prize, in accordance with these Rules;
• Administrator is unable to deliver the Prize for any reason; or
• As may be required by any governmental agency with authority over sweepstakes regulation.
IN THE EVENT OF ANY DISQUALIFYING EVENT, ADMINISTRATOR RESERVES THE RIGHT, BUT IS NOT REQUIRED TO, AWARD OR DISPOSE OF THE PRIZE, AS DEEMED FAIR AND APPROPRIATE BY ADMINISTRATOR, IN ITS BUSINESS JUDGMENT, INCLUDING WITHOUT LIMITATION, DISQUALIFYING ALL SUSPECT ENTRIES AND/OR SELECTING NEW WINNER(S) USING THE SAME WINNER SELECTION METHOD. IF ADMINISTRATOR DOES SELECT A NEW WINNER, THE NEW WINNER WILL BE SELECTED FROM THE REMAINING POOL OF NON-WINNING ENTRANTS.
PUBLICITY AND PRIVACY POLICY. By entering this Sweepstakes, you grant Administrator the non exclusive, perpetual, worldwide, royalty-free, sub-licensable and transferrable right and license to use, modify, and exploit, in a non-disparaging manner, in any and all media now known or later devised, your name, image, likeness, and biographical information (collectively, your “Likeness”), in connection with this Sweepstakes and any products, services, and advertising or promotional material related thereto, without any further compensation, consideration, notice to, or approval by, you. Additionally, Administrator may use any non-personally identifiable information provided by you or collected by Administrator in connection with your entry into this Sweepstakes, in accordance with Administrator’s Privacy Policy (link above).
USE OF DATA. Administrator will be collecting personal data about Entrants online, in accordance with its privacy policy. Please review the Administrator’s privacy policy at https://www.chivemediagroup.com/legal/privacy. By participating in the Sweepstakes, Entrants hereby agree to Administrator’s collection and usage of their personal information and acknowledge that they have read and accepted Administrator’s privacy policy.
REPRESENTATIONS AND WARRANTIES.
You represent and warrant that Your entry does not and will not violate or infringe upon the rights of any third party.
LICENSE TO ENTRIES. By entering this Sweepstakes, you grant Administrator a non-exclusive, perpetual, worldwide, royalty-free, sub-licensable and transferrable right and license to use, modify, copy, publicly perform and display, exhibit, and otherwise exploit, in any and all media now known or later devised, all works of authorship, material, content, or other intellectual property submitted by you in connection with this Sweepstakes (collectively, “Material”), in connection with this Sweepstakes and any products, services, and advertising or promotional material related to the Sweepstakes, without any further compensation, consideration, notice to, or approval by, you. You further represent and warrant that: (a) you are the owner or a valid licensee of all Material; (b) you have full right, permission, and consent, without the necessity of obtaining the consent of any third party, to grant to Administrator all rights, licenses, and consents under these Rules; and (c) the Material does not violate or infringe upon the rights of any third party.
THIRD PARTY TERMS. If entry into this Sweepstakes requires you to make use of any third-party products or services, including without limitation, third party, apps, websites, social media platforms, or email service (collectively, “Third Party Services”), then by entering the Sweepstakes, you agree to abide by the rules, policies, terms, and conditions governing the use of each of those Third-Party Services.
RELEASE. BY ENTERING THIS SWEEPSTAKES, YOU FOREVER RELEASE AND HOLD HARMLESS THE ADMINISTRATOR AND ITS RESPECTIVE OFFICERS, DIRECTORS, AGENTS, REPRESENTATIVES, AND EMPLOYEES (COLLECTIVELY, “RELEASEES”) FROM AND AGAINST ANY CLAIMS, LIABILITIES, JUDGMENTS, DAMAGES, LOSS, ACTIONS OR CAUSE OF ACTION, AND COSTS (INCLUDING REASONABLE ATTORNEY’S FEES) (COLLECTIVELY, “CLAIMS”), KNOWN OR UNKNOWN, SUSPECTED OR UNSUSPECTED, THAT YOU MAY NOW OR LATER HAVE, ARISING FROM OR RELATED TO YOUR ENTRY INTO, INABILITY TO ENTER INTO, OR PARTICIPATION IN THE SWEEPSTAKES. YOUR FOREGOING WAIVER AND RELEASE INCLUDES, WITHOUT LIMITATION, ALL CLAIMS ARISING FROM OR RELATED TO: (A) THE NEGLIGENCE OF ANY RELEASEE OR ANY THIRD PARTY; (B) PHYSICAL AND/OR MENTAL INJURY, HARM, DAMAGES, DISABILITY, ILLNESS, DEATH, AND/OR OTHER OR LOSS TO YOU OR YOUR PROPERTY; (C) LOST, LATE, MISDIRECTED, DAMAGED, STOLEN, ALTERED, GARBLED, FRAUDULENT, INCORRECT, INCOMPLETE, OR DELAYED ENTRIES; (D) RECEIPT, USE, OR MISUSE OF THE PRIZE; (E) ERRORS OR MALFUNCTIONS OF ANY EQUIPMENT, COMPUTER, ONLINE SYSTEMS, SERVERS, PROVIDERS, OR COMPUTER HARDWARE OR SOFTWARE FAILURES; (F) THIRD PARTY INTERVENTION INTO THE SWEEPSTAKES OR OTHER TECHNICAL OR HUMAN ERRORS OR MALFUNCTIONS OF ANY KIND; (G) USE OF THE WEBSITE ON WHICH THE SWEEPSTAKES IS CONDUCTED; AND (H) THE CANCELLATION, SUSPENSION, OR MODIFICATION OF THE SWEEPSTAKES OR THE DISQUALIFICATION OF ANY ENTRANT OR WINNER.
CALIFORNIA RESIDENTS. IF YOU ARE A RESIDENT OF CALIFORNIA, YOU EXPRESSLY WAIVE AND RELINQUISH ALL RIGHTS AND BENEFITS AFFORDED BY CALIFORNIA CIVIL CODE SECTION 1542, AND DO SO UNDERSTANDING AND ACKNOWLEDGING THE SIGNIFICANT OF SUCH SPECIFIC WAIVER OF SECTION 1542. SECTION 1542 OF THE CIVIL CODE OF THE STATE OF CALIFORNIA STATES AS FOLLOWS:
A GENERAL RELEASE DOES NOT EXTEND TO CLAIMS WHICH THE CREDITOR DOES NOT KNOW OR SUSPECT TO EXIST IN HIS OR HER FAVOR AT THE TIME OF EXECUTING THE RELEASE, WHICH IF KNOWN BY HIM OR HER MUST HAVE MATERIALLY AFFECTED HIS OR HER SETTLEMENT WITH THE DEBTOR.
THUS, NOTWITHSTANDING THE PROVISIONS OF SECTION 1542, AND FOR THE PURPOSE OF IMPLEMENTING A FULL AND COMPLETE RELEASE AND DISCHARGE OF RELEASEES, YOU EXPRESSLY ACKNOWLEDGE THAT THE RELEASE GRANTED BY YOU BY THESE RULES IS INTENDED TO INCLUDE IN ITS EFFECT, WITHOUT LIMITATION AND WITH RESPECT TO THE ENTIRETY OF THE RELEASE HEREIN, ALL CLAIMS NOT KNOWN OR SUSPECTED BY YOU AND ALL FACTS IN ADDITION TO OR DIFFERENT FROM THOSE WHICH YOU CURRENTLY KNOW OR BELIEVE TO BE TRUE, AND THAT THIS RELEASE CONTEMPLATES THE EXTINGUISHMENT OF ANY SUCH CLAIMS WHICH YOU MAY HAVE AGAINST ANY RELEASEES.
NON-CALIFORNIA RESIDENTS OF STATES WITH SIMILAR LAWS. IF YOU ARE NOT A CALIFORNIA RESIDENT, BUT ARE A RESIDENT OF A STATE WITH A PROVISION SUBSTANTIALLY COMPARABLE TO THAT OF SECTION 1542 OF THE CALIFORNIA CIVIL CODE, YOU EXPRESSLY WAIVE THE BENEFITS OF THE APPLICABLE LAWS OF ANY STATE OR OTHER JURISDICTION WHICH ARE SUBSTANTIALLY COMPARABLE TO SECTION 1542 OF THE CALIFORNIA CIVIL CODE, AND ALL PROVISIONS OF THESE RULES APPLICABLE TO SECTION 1542 WILL APPLY WITH FULL FORCE AND EFFECT TO YOUR STATE’S COMPARABLE PROVISION.
LIMITATION OF LIABILITY. THE RELEASEES WILL NOT BE LIABLE FOR ANY INDIRECT, SPECIAL, INCIDENTAL, CONSEQUENTIAL, EXEMPLARY OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION, DAMAGES FOR LOST DATA, LOST PROFITS, LOST REVENUE, LOST BUSINESS, ANTICIPATED PROFITS, COSTS OF PROCUREMENT OF SUBSTITUTE GOODS OR SERVICES, HOWEVER CAUSED AND UNDER ANY THEORY OF LIABILITY, AND REGARDLESS OF WHETHER THE RELEASEES WERE OR SHOULD HAVE BEEN AWARE OF OR ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
INDEMNIFICATION. By entering this Sweepstakes, you indemnify, defend, and hold harmless Administrator from and against any all third party Claims related to your: (a) breach or violation of these Rules or of any representation, warranty, or provision contained herein or otherwise made in connection with the Sweepstakes; (b) causing physical and/or mental injury, harm, damage, disability, illness, death, loss, or damage to any third party; (c) violation of or infringement upon the rights of any third party; or (d) violation of any applicable law, rule, or regulation.
NO TAMPERING. ANY ATTEMPT BY ANY PERSON TO UNDERMINE OR TAMPER WITH THE LEGITIMATE OPERATION OF THIS SWEEPSTAKES IS A VIOLATION OF CRIMINAL AND CIVIL LAWS, FOR WHICH ADMINISTRATOR RESERVES THE RIGHT TO SEEK DAMAGES FROM ANY SUCH PERSON TO THE FULLEST EXTENT PERMITTED BY LAW.
JURISDICTION. This Sweepstakes and these Rules will be governed by the laws of the State of Texas, without regard to conflict of law principals. Any disputes arising from or relating to this Sweepstakes, these Rules (including their construction, validity, and enforceability), the Prize, and/or any rights or obligations hereunder will be adjudicated, individually (not by any class or representative action), exclusively in the State or Federal Courts located in Austin, Texas.
GAMBLING PROHIBITED. This Sweepstakes is for entertainment purposes only and may not be used as or in connection with any form of gambling.
FORCE MAJEURE. It is understood and agreed that in the event of an act of the government, or war conditions, epidemic, pandemic, quarantine, fire, flood, riots, or changes in law or regulations, which prevents the performance by Administrator of the provisions of this Agreement, then such non-performance by LICENSEE shall not be considered as grounds for breach of this Sweepstakes and such non-performance shall be excused while the conditions herein prevail.
NO THIRD-PARTY ENDORSEMENT. This Sweepstakes is not associated with or administered, sponsored, or endorsed by, any Third-Party Services, or any person or entity other than Administrator.
ENTIRE AGREEMENT; SAVINGS PROVISION. These Sweepstakes Rules constitute the entire agreement between you and Administrator. If any provision of the Sweepstakes Rules is held to be invalid or unenforceable, all remaining provisions hereof will remain in full force and effect.
RULES; WINNER LIST; QUESTIONS. To receive a copy of these Rules or the winner list, within 15 days after the end of the Sweepstakes Period, send a self-addressed stamped envelope to: Chive Media Group, LLC, attn. Murray NFT Sweepstakes Rules, 98 San Jacinto Blvd., Suite 160, Austin, TX 78701. The winner list will be mailed approximately 15 days after receipt of requests therefore.
